‘We’re after leakers, not journalists’: DOJ defends crackdown on leaks of classified info

US Deputy Attorney General Rod Rosenstein has said his office is to “respond appropriately” to the issue of increasing leaks in the US, and warned there is a possibility that reporters, not just their sources, might be held accountable.

“We don’t prosecute journalists for doing their jobs. We look at the facts and circumstances of each case and we determine whether somebody has committed a crime and whether it’s appropriate to hold them accountable for it,” Rosenstein said in an interview on ‘Fox News Sunday.’

However, he said, there might be some exceptions where a reporter might become a suspect in a leak case as well as its source.

“Generally speaking, reporters who publish information are not committing a crime. But there might be a circumstance where they do. You know, I haven’t seen any of those today, but I wouldn’t rule it out in the event that there were a case where a reporter was purposely violating the law, then they might be a suspect as well,” he said.

A new unit within the FBI has been created “to focus on those leaks,” he said, adding that the government is “going to devote whatever resources are necessary to get them under control.”

“Criminal prosecution isn’t the only way to prevent leaks, but it’s an important part of the solution,” he said.

“We’re after the leakers, not the journalist,” the deputy attorney general claimed, adding that the Justice Department has not yet revised any policies with regard to reporters.

Earlier this week, his boss, Attorney General Jeff Sessions, described the issue of leaks in the country as a threat to national security, warning of a possible crackdown on those who are spreading information illegally.

“We respect the important role that the press plays and will give them respect, but it is not unlimited,” Sessions warned, promising to step up legal procedures to hold journalists accountable for disseminating sensitive information.

“One of the things we are doing is reviewing policies affecting media subpoenas” which would force journalists to testify in court and potentially produce evidence, Sessions explained.

Under the US’ shield law, journalists are protected under “reporters’ privilege,” which gives them the legal right not to reveal confidential sources or other information that would hinder news gathering activity.

The attorney general also revealed that the Justice Department has tripled the number of investigations into unauthorized leaks, charging four people with crimes so far. The department has received almost as many criminal referrals over leaks as over the past three years combined, Sessions told reporters Friday.

Sessions also noted that it is the responsibility of government agency workers to stop leaking information which concerns national security. “This culture of leaking must stop,” Sessions stated.

3 CNN journalists behind retracted Russia-Trump story resign

Three journalists, including the executive editor of a new investigative branch, have left CNN following the recent retraction of a story on an alleged Congress investigation into a “Russian investment fund with ties to Trump officials.”

Report author Thomas Frank and two senior CNN Investigations Unit figures resigned over the story. Investigations Unit editor Eric Lichtblau and Lex Haris, CNN Investigations executive editor, who was building a team that includes notorious Russia-hawk Michael Weiss, both resigned.

“In the aftermath of the retraction of a story published on CNN.com, CNN has accepted the resignations of the employees involved in the story’s publication,” CNN stated.

The Russia-related article quoted “a single anonymous source,” and was to be examined by “fact-checkers, journalism standards experts and lawyers” before being presented to the public. Haris, Lichtblau, and Frank failed to follow “some standard editorial processes,” a CNN internal investigation concluded.

“This breakdown in editorial workflow disturbed the CNN executives who learned about it,” CNN correspondent Brian Stelter said.

The resignations of the three men, who are experienced journalists, “are likely to come as a surprise to colleagues.” Lichtblau was awarded a Pulitzer Prize, and Haris had been working at the company since 2001 and was the executive editor of CNN Money before joining the investigative unit.

“On Friday, CNN retracted a story published by my team. As Executive Editor of that team, I have resigned,” Haris said.

CNN, however, has not concluded that “the facts of the story were necessarily wrong,” saying that “the story wasn’t solid enough to publish as-is,” the correspondent said, citing people involved in the investigation.

Following the journalists’ departures, US President Donald Trump’s son, Donald Trump, Jr., called the story “the biggest fake news scandal in the network’s history,” and called on the company’s president, Jeff Zucker, to admit the story was fake.

“Maybe Jeff Zucker should do an on-camera press briefing about CNN’s fake news scandal before the White House does any more of them,” he told Breitbart News.

The story claimed that the Senate Intelligence Committee was investigating ties between several figures in the Trump camp and the Russian Direct Investment Fund (RDIF). The article mentioned a meeting between Trump’s ally and financier, Anthony Scaramucci, and the CEO of the RDIF, Kirill Dmitriev, claiming that the investigators wondered if they had discussed lifting US sanctions against Russia at the World Economic Forum in Davos last year. Both sides denied speaking on the topic, while Scaramucci told CNN that there was “nothing there.” The news company had to apologize to the financier.

Following the scandal, a report emerged on BuzzFeed, saying that all Russia-related articles will be under “new publishing restrictions.” BuzzFeed cited a leaked email which prohibits publishing “any content involving Russia” before showing it to the executive editor of CNN Money, Rich Barbieri, and Vice President of Premium Content Video Jason Farkas.

On Jan. 18, Barack Obama used his final press conference as president to pledge to the public that he will speak up if the administration of Donald Trump crosses a line, whether that’s imposing “systematic discrimination” or silencing the press. “There’s a difference between that normal functioning of politics and certain issues or certain moments where I think our core values may be at stake,” Obama told journalists assembled in the White House briefing room. “I would put in that category efforts to round up kids who have grown up here and for all practical purposes are American kids and send them someplace else.”

Yet the president’s palliative remarks that afternoon concealed a more harrowing truth: Sweeps and forced expulsions of children would not constitute a break with norms of his own administration, which oversaw more deportations than any other in U.S. history. During Obama’s tenure, mass incarceration of mothers and their children became a mainstay of the U.S. response to the violent displacement of peoples across Central America. And amid the greatest refugee crisis since World War II, Obama has greatly expanded the deportation machine, overseeing a higher number of border patrols than any previous administration. That deportation machine is now being handed to Trump, whose administration is aggressively delivering on his campaign pledges to slam the door on refugees and migrants.

Why would Hollande want Netanyahu not to attend? It’s a request that’s easy to demagogue. But it is neither surprising nor unreasonable. The French government is trying to keep the Middle East conflict off the streets of France. And Netanyahu’s presence visibly reinjects it into the mix. Netanyahu is also in the midst of an election battle for his political life. So whether he wants to or not, everything he does tied to the kosher grocery massacre is inherently political, inherently part of his campaign. It’s unavoidable.

Two journalists in Jordan got into a heated discussion of the ongoing civil war in Syria Tuesday, flipping over and tearing apart the table in the studio. The Associated Press reports that it all started when Mohammad al-Jayousi “accused” Shaker al-Johari “of supporting the Syrian rebels” and al-Johari “accused” al-Jayousi “of taking money for supporting Assad.”
