The attorney for San Diego Mayor Bob Filner says the city could well be liable for “failing to prevent harassment” in the sexual harassment lawsuit brought against its mayor.

“If there is any liability at all, the City will almost certainly be liable,” Filner’s attorney, Harvey Berger, wrote in a letter Monday to San Diego City Attorney Jan Goldsmith.

Berger explained that San Diego is obligated to provide its management-level employees with sexual harassment training, which he said the city failed to do for Filner.

Eight women have accused Filner of sexual harassment and the first to do so, his former communications director Irene McCormack Jackson, filed a lawsuit against the mayor last week. Berger’s letter refers to this lawsuit.
